Distance Sales Agreement
This agreement is concluded electronically between AutoECUFile as Seller and you as Buyer each time you complete an order on autoecufile.com. It is prepared under Law No. 6502 on the Protection of the Consumer and the Distance Contracts Regulation, and it is adapted to digital ECU files, which are delivered instantly and not shipped.
- The product is the digital ECU file named in your order, identified by its hardware and software numbers.
- It is delivered instantly to your account and e-mail; no shipping, no shipping cost.
- Because delivery is immediate and you consent to it at checkout, the withdrawal right does not apply after download; faulty or mislisted files are replaced or refunded.
- Disputes: Consumer Arbitration Committees / Consumer Courts; otherwise the courts of Malatya, Türkiye.

Buyer
The natural or legal person whose name, e-mail address and billing details are entered at checkout and shown on the order confirmation. The Buyer declares that these details are accurate.
02 Subject
This agreement sets out the rights and obligations of the parties regarding the sale and electronic delivery of the digital ECU file(s) (the “Product”) that the Buyer ordered on the Seller’s website, with the qualities and price stated in the order.
03 Product, price and payment
The Product is the digital file listed on the product page selected by the Buyer, identified by its name, ECU model, hardware number, software number and, where shown, software version and engine code. These identifiers, the unit price, VAT (KDV) and the total amount are displayed on the product page, in the cart and on the checkout page before the order is confirmed, and are repeated in the order confirmation e-mail.
Prices are in euro (EUR). Payment is made by credit or debit card through the iyzico payment infrastructure using 3D Secure. The Seller does not receive or store card details. If the Buyer’s bank does not authorise the payment, no contract is formed and no file is delivered.
04 Delivery
The Product is delivered electronically, without physical shipment and without shipping charges. Immediately after the payment is authorised, the download link is made available on the order confirmation page, in the Buyer’s account under Downloads, and in the order confirmation e-mail sent to the Buyer’s address. The Product is considered delivered when the download link is made available. The Buyer can download the Product again later from the account.
If the download link is not delivered or does not work, the Buyer notifies the Seller and the Seller re-issues the link without delay. If delivery is impossible, the Seller informs the Buyer within 3 days and refunds the total price within 14 days.
05 Preliminary information
The Buyer confirms that, before placing the order, they read and accepted the preliminary information on the product page, the cart and the checkout page: the essential characteristics of the Product (identification numbers), the price including taxes, the payment method, the instant electronic delivery, the exception to the right of withdrawal for digital content, and the Seller’s contact details.
06 Right of withdrawal
Under Article 15/1(ğ) of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for digital content delivered instantly in electronic form with the consumer’s express consent. By confirming the order, the Buyer expressly consents to instant delivery and acknowledges that the right of withdrawal ends once the Product is delivered.
Independently of the withdrawal right, the Seller replaces or refunds a Product that is not delivered, is corrupt, or does not match the identification numbers stated on the product page, as described in the Cancellation and Refund Policy. A Product that has not yet been downloaded can be cancelled on request and is refunded in full.
07 Seller’s obligations
- to deliver the Product electronically immediately after payment and to keep it available in the Buyer’s account;
- to describe the Product accurately by its identification numbers;
- to replace or refund a Product that is undelivered, corrupt or mislisted;
- to provide support by e-mail and through the contact page.
08 Buyer’s obligations
- to give accurate identity, e-mail and billing details;
- to compare the numbers on the ECU label with the Product before purchase and before writing the file, and to back up the original content of the unit;
- to use the Product only under the licence in the Terms and Conditions: for the Buyer’s own vehicles or the vehicles the Buyer services, without resale or redistribution;
- to check that a modified file (immo off, DPF off, EGR off, tuning) may lawfully be used on the vehicle concerned;
- to pay the price with a card the Buyer is entitled to use.
09 Defective performance
A Product is defective if it does not correspond to its identification numbers or cannot be opened. In that case the Buyer may request a corrected file or a refund. The Seller is not responsible for damage resulting from writing a file to a unit whose numbers differ from the Product, from faulty tools, wiring or power supply, or from the use of a modified file in breach of applicable law. Mandatory consumer rights remain unaffected.
10 Personal data
The Seller processes the Buyer’s personal data for the performance of this agreement and the fulfilment of legal obligations, as described in the Privacy and Security Policy, in accordance with Law No. 6698 on the Protection of Personal Data (KVKK).
11 Disputes
Consumer Arbitration Committees and Consumer Courts at the Buyer’s or the Seller’s place are competent for consumer disputes within the monetary limits announced annually by the Ministry of Trade. For disputes that are not consumer disputes, the courts and enforcement offices of Malatya, Türkiye, have jurisdiction. The Seller’s electronic records, order and download logs are evidence in any dispute.
12 Entry into force
This agreement enters into force when the Buyer confirms the order on the checkout page and the payment is authorised. A copy is available on this page at all times; the order confirmation e-mail contains the specific details of each contract.
